ISBP 745 A12: Pre-Shipment Event Evidence Versus Later Issuance Dates

Introduction

The illusion is that any certificate dated after the bill of lading is late, so the examiner compiles a refusal labelled “inspection after shipment.” ISBP 745 A12 is narrower. A12(a) states that a certificate of analysis, an inspection certificate or a fumigation certificate may indicate a date of issuance later than the date of shipment. A12(c) states that a credit that requires an “inspection certificate” does not constitute a requirement that the document evidence a pre-shipment event, and it need not be dated prior to the date of shipment. The opposite limb is also binary. A12(b) fires only when the credit requires a document to evidence a pre-shipment event. Then the document, by its title, content or date of issuance, is to indicate that the event took place on or prior to the date of shipment. Mutating a later issuance date into a discrepancy, or ignoring a true pre-shipment-event miss, violates A12. Both errors are systemic: one truncates a complying presentation; the other honours a document that does not evidence the event the credit required.

Failure Mode Analysis

Failure Mode 1: Later Issuance Date Mutated into a Discrepancy

The credit requires a certificate of analysis and an inspection certificate. It does not require a pre-shipment event. The bill of lading shows shipment on 4 May. The certificate of analysis is issued on 8 May. The examiner refuses because “analysis after shipment.” ISBP 745 A12(a) states that a certificate of analysis, inspection certificate or fumigation certificate may indicate a date of issuance later than the date of shipment. ISBP 745 A12(c) states that requiring an “inspection certificate” does not constitute a requirement that the document evidence a pre-shipment event, and it need not be dated prior to the date of shipment. The refusal violates A12(a) and A12(c).

Deterministic resolution: Ask whether the credit requires a document to evidence a pre-shipment event. If it does not, A12(b) is off. Apply A12(a) and A12(c). A later issuance date is not a discrepancy. Still apply Article 14(i): the document must not be dated later than its date of presentation. Still apply Article 14(d) to data conflict. Do not compile a cease from the later date alone.

Failure Mode 2: Pre-Shipment Event Required, None of Title, Content or Issuance Date Evidences It

The credit requires a “pre-shipment inspection certificate.” The presented document is titled “Inspection Certificate.” Its content does not state that inspection occurred on or prior to shipment. Its date of issuance is 12 May. The bill of lading shows shipment on 4 May. The examiner honours because “an inspection certificate was presented” and Article 14(f) accepts function. ISBP 745 A12(b) states that when a credit requires a document to evidence a pre-shipment event, the document, either by its title, content or date of issuance, is to indicate that the event took place on or prior to the date of shipment. None of the three channels indicates that fact. Honour violates A12(b). Article 14(f) does not delete A12(b) when the credit stipulated the pre-shipment event in the document requirement.

Deterministic resolution: Confirm the credit requires evidence of a pre-shipment event. Test title, then content, then date of issuance. If any one channel indicates the event took place on or prior to the date of shipment, A12(b) is satisfied. If none does, truncate. Refuse under Article 16. Do not mutate Article 14(f) into a waiver of A12(b).

Failure Mode 3: Article 28(e) or A13 Box Date Mutated onto the A12 Operand

Two related mutations. First, the examiner applies Article 28(e) to the inspection certificate and refuses a later issuance date because “cover must be no later than shipment.” Article 28(e) governs the insurance document. A12(a) governs the certificate class it names. The mutation violates A12(a) and misreads Article 28. Second, the credit requires a pre-shipment inspection certificate. The document shows an issuance box of 1 May and a signature dated 10 May. Shipment is 4 May. The examiner treats 1 May as the issuance date and accepts the document on the issuance-date channel of A12(b). ISBP 745 A13 states that a document indicating a date of issuance and a later date of signing is deemed to have been issued on the date of signing. Deemed issuance is 10 May, after shipment. If title and content also fail to indicate a pre-shipment event, A12(b) fails. Accepting the box date violates A13.

Deterministic resolution: Apply Article 28(e) only to the insurance document. Apply A12 only to the certificate class in A12. When testing the issuance-date channel of A12(b), apply A13 first: later signing date is the deemed issuance date. Then compare that date to the date of shipment. Title or content can still satisfy A12(b) even if deemed issuance is after shipment.

Deterministic Resolution Architecture

  1. Identify the document class. If the presented document is a certificate of analysis, an inspection certificate, a fumigation certificate, or a like certificate, A12 is in scope. If it is an insurance document, stop A12. Apply Article 28(e) and ISBP 745 K. If it is a bill of lading, stop A12. Apply Article 20. If it is a commercial invoice, stop A12. Apply Article 18.

  2. Read the shipment date as an input. Take the date of shipment from the original transport document under Articles 19–25 as applicable. Article 20(a)(ii) produces that date on a bill of lading. Do not examine the bill of lading under A12.

  3. Ask whether the credit requires evidence of a pre-shipment event. The A12(b) example is “pre-shipment inspection certificate.” Equivalent wording that requires the event to occur before shipment turns A12(b) on. A bare “inspection certificate,” “certificate of analysis,” or “fumigation certificate” leaves A12(b) off. Apply A12(c).

  4. If A12(b) is off, permit a later issuance date. A12(a) states that the document may indicate a date of issuance later than the date of shipment. A12(c) states it need not be dated prior to the date of shipment. Do not refuse on that date alone.

  5. If A12(b) is on, test three channels. Title, content, or date of issuance must indicate that the event took place on or prior to the date of shipment. One channel is enough. For the issuance-date channel, apply A13: a later signing date is the deemed issuance date.

  6. Apply Article 14(i) after A12. A document may be dated prior to the issuance date of the credit, but must not be dated later than its date of presentation. A12 does not override 14(i).

  7. Apply Article 14(f) and Article 14(d) without deleting A12. If the credit does not stipulate issuer or data content, accept the document as presented if it appears to fulfil the function of the required document and does not conflict under 14(d). Function does not erase an A12(b) miss. A 14(d) conflict is a separate discrepancy.

  8. Do not apply Article 14(c) to the certificate issuance date. Article 14(c) is the 21 calendar day presentation period for a presentation that includes original transport documents subject to Articles 19–25. It is not an issuance-date rule for A12 documents.

  9. Honour or refuse on the actual gate. If A12(a) and A12(c) apply and 14(i) and 14(d) are clean, Article 15(a) requires honour when the presentation is otherwise complying. If A12(b) failed, Article 16(c) requires a single notice listing that discrepancy. Do not list an A12(b) miss when A12(b) never applied.

Conclusion

ISBP 745 A12 is a three-limb date architecture. A12(a) permits a certificate of analysis, an inspection certificate or a fumigation certificate to show an issuance date later than the date of shipment.
