UCP 600 Article 39 — Examining Packing Lists Under Assigned Credits

📅 2026-07-13 3 min read UCP 600 / ISBP 745

Introduction

When a credit has been the subject of an assignment of proceeds, the examining bank must evaluate packing lists against the credit terms under the same standards that apply to any presentation. Article 39 does not modify the examination framework for packing lists. This guide addresses the specific issues that arise when packing lists are presented under an assigned credit.

Failure Mode Analysis

Failure Mode 1: Packing List Data Conflicts with Invoice

The packing list describes quantities or weights that differ from the commercial invoice. This is a discrepancy under Article 14(d) regardless of the assignment.

Failure Mode 2: Assignee Presents Packing List

The assignee, believing it has rights, presents the packing list. The bank must refuse because the assignee is not the beneficiary.

Failure Mode 3: Missing Packing List When Required

The credit requires a packing list but the beneficiary does not present one. The assignment does not excuse the omission.

Deterministic Resolution Architecture

  1. Confirm the presenting party is the beneficiary or its authorized agent.
  2. Verify whether the credit requires a packing list — if not, the document may be disregarded under Article 14(f).
  3. If required, examine the packing list on its face against the credit terms.
  4. Confirm the packing list data (quantities, weights, dimensions) is consistent with the commercial invoice and bill of lading.
  5. Verify the packing list describes the goods in a manner consistent with the credit description.
  6. Check that the packing list does not conflict with other stipulated documents under Article 14(d).
  7. Process the assignment payment after confirming documentary compliance and assignment consent.
  8. Remit the assigned proceeds to the assignee after payment.

Conclusion

The packing list examination under an assigned credit follows the same standards as any presentation. Article 14(f) and 14(d) govern the examination. Article 39 adds a consent verification but does not alter the document examination.

FAQ

Can the assignee present the packing list?
No. The beneficiary must present all documents. The assignee has no presentation rights under Article 39.

What if the credit does not require a packing list?
Under Article 14(f), a document not required by the credit may be disregarded. The bank does not examine it.

Does the packing list need to match the invoice exactly?
Article 14(d) requires no conflict, not exact identity. Minor formatting differences are acceptable; factual discrepancies in quantities or weights are not.

Can the packing list include information not in the credit?
Yes. Article 14(d) permits additional data in a document, provided it does not conflict with the credit or other stipulated documents.

Does ISBP 745 provide specific guidance for packing lists?
Yes. ISBP 745 paragraphs C12–C16 address certificates and similar documents, including supporting documents.
